1. Introduction and Acceptance

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("the Customer," "you," or "your") and Magic Hand Car Wash Franchisor Pty Ltd (ACN 101 257 023), trading as Korsgate Auto Care ("Korsgate," "we," "us," or "our"). By accessing the website located at korsgate.com, making a booking, purchasing a service, or otherwise engaging with Korsgate Auto Care, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any provision set forth herein, you must refrain from using our website and services.

2. Description of Services

Korsgate Auto Care provides professional vehicle care services, including but not limited to exterior and interior car washing, hand washing, full and partial detailing, ceramic paint protection and coating, alloy wheel cleaning and restoration, engine bay cleaning, headlight restoration, and mobile car wash and detailing services. The specific scope, inclusions, and pricing of each service are described on the relevant service pages of our website and may be updated from time to time at our sole discretion.

Membership and subscription plans, where offered, are governed by the specific terms applicable to each plan as described at the time of purchase. We reserve the right to modify, suspend, or discontinue any service offering without prior notice, subject to honouring existing bookings and pre-paid memberships.

3. Pricing and Payment

All prices displayed on our website and at our premises are quoted in Australian Dollars (AUD) and are inclusive of GST unless otherwise stated. We reserve the right to amend pricing at any time; however, any price change shall not affect bookings that have already been confirmed and paid for at the prior rate.

Payment is required at the time of service unless an alternative arrangement has been expressly agreed upon. We accept payment via credit card, debit card, and such other methods as may be indicated at our premises or on our website. You warrant that any payment information you provide is accurate, that you are authorised to use the payment method, and that sufficient funds are available to cover the transaction. In the event of a failed or dishonoured payment, we reserve the right to withhold the delivery of services until the outstanding amount is settled in full.

4. Bookings and Cancellations

Bookings may be made through our website, by telephone, or in person. A booking constitutes a confirmed appointment for the selected service at the specified date and time, subject to availability. We shall make reasonable efforts to accommodate your preferred time but do not guarantee availability.

Should you need to cancel or reschedule a booking, we request that you provide at least 24 hours' notice. Cancellations made with less than 24 hours' notice, or failure to present the vehicle at the agreed time without prior communication, may result in a cancellation fee equivalent to 50% of the booked service price. We reserve the right to cancel or reschedule a booking due to unforeseen circumstances, including but not limited to severe weather, equipment failure, or staffing shortages. In such cases, we shall offer an alternative appointment or a full refund at the Customer's election.

5. Vehicle Condition and Pre-Existing Damage

You acknowledge and agree that vehicles presented for service may already bear pre-existing damage, including but not limited to scratches, dents, paint imperfections, faded trim, loose fittings, cracked windscreens, or deteriorated surfaces. Korsgate Auto Care accepts no liability for any pre-existing condition of the vehicle. Our staff may conduct a visual inspection prior to commencing work and may document existing damage. However, the absence of documented damage does not constitute a warranty or representation that no pre-existing damage exists.

Certain services, particularly machine polishing, clay bar treatment, and ceramic coating, involve processes that may reveal latent defects not visible under ordinary conditions. By requesting such services, you accept the risk that underlying paint or surface defects may become apparent during or after treatment. Korsgate Auto Care shall not be held responsible for the revelation of such latent defects.

You are responsible for removing all valuable personal belongings from your vehicle prior to service. We do not accept liability for the loss of, or damage to, personal items left in the vehicle during service, except to the extent caused by our wilful misconduct or gross negligence.

6. Limitation of Liability

To the maximum extent permitted by law, Korsgate Auto Care's total liability to you for any claim arising out of or in connection with these Terms or the provision of services shall not exceed the amount paid by you for the specific service giving rise to the claim. This limitation applies regardless of the basis of the claim, whether in contract, tort (including negligence), statute, or otherwise.

Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable legislation that cannot be excluded, restricted, or modified by agreement. To the extent that our liability cannot be excluded, it is limited, at our option, to the re-supply of the services or the payment of the cost of having the services re-supplied.

7. Complaints Procedure

We are committed to resolving any concerns promptly and fairly. If you are dissatisfied with any aspect of our service, please raise the matter with our team at the time of service where possible. Alternatively, you may submit a formal complaint in writing via email to info@korsgate.com or by telephoning 03 9419 7419 within 48 hours of the service date. Please include your name, contact details, date of service, and a description of the issue.

Upon receipt of a complaint, we shall acknowledge it within two business days and endeavour to resolve the matter within five business days. Where an inspection of the vehicle is necessary, we may request that you bring the vehicle to our premises at a mutually agreed time. Our resolution may include re-performing the service, offering a partial or full refund, or providing a credit toward a future service, as appropriate to the circumstances.

8. Intellectual Property

All content published on korsgate.com — including text, graphics, logos, images, photographs, icons, software, and the compilation thereof — is the property of Magic Hand Car Wash Franchisor Pty Ltd or its licensors and is protected by Australian and international copyright, trademark, and other intellectual property laws. The Korsgate Auto Care name, logo, and all related marks are trademarks of Magic Hand Car Wash Franchisor Pty Ltd.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the website for personal, non-commercial purposes. You shall not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from the website without our prior written consent.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Victoria, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of the State of Victoria and the Federal Court of Australia sitting in Victoria for the resolution of any dispute arising under or in connection with these Terms.

10. Modifications to These Terms

We reserve the right to amend these Terms at any time by publishing revised Terms on this page with an updated effective date. It is your responsibility to review these Terms periodically. Your continued use of our website or services following the publication of amended Terms constitutes your acceptance of such amendments. Material changes may, at our discretion, be communicated via email to customers who have provided their contact details.

11. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed from these Terms to the minimum extent necessary, and the remaining provisions shall continue in full force and effect. The invalid provision shall, to the extent possible, be interpreted in a manner consistent with its original intent while rendering it enforceable.

12. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Refund Policy, constitute the entire agreement between you and Korsgate Auto Care with respect to your use of the website and services. They supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and Korsgate Auto Care relating to the subject matter herein.
